Soldier refuses to serve under Obama

U.S. Army Maj. Stefan Frederick Cook, who should be getting ready to deploy to Afghanistan, is instead seeking a temporary restraining order under the guise of being a conscientious objector. Cook is a birther who is arguing that President Obama is not a natural born citizen and, therefore, ineligible to be commander-in-chief. Cook’s lawyer is Orly Taitz — dubbed The Queen Bee of Birferstan for challenging the legitimacy of Obama’s presidency in California:

In the 20-page document — filed July 8 with the U.S. District Court for the Middle District of Georgia — the California-based Taitz asks the court to consider granting his client’s request based upon Cook’s belief that Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces.

Cook further states he “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command. … simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.”

When not filing suit against his commander-in-chief, Cook has also made time to post at the conservative website FreeRepublic.

  1. Looks like this soldier is refusing to take orders from a superior. A serious military offense. I hope he enjoys his time in the slammer!

  2. I am one moral and fiscal conservative who believes this soldier for refusing to obey a lawful order from his Commander in Chief should be courtmartialed and dishonorably discharged.

    If he truly believes Obama is not born in this country (up for debate), he has no right to take things into his own hands. That is why we got our legal system. Obama’s opponents had during the elections every opportunity to show Obama was not born here- but hard for someone like McCain to do, since he was not born here either. Whether Obama is born here or not, I don’t know and don’t care when it comes to issue of military chain of command.

    Obama was still duly elected. Thus, as it remains right now, he is our President and our commander in chief. I may not have voted for him and may disagree with him on nearly everything, but as a Christian conservative, I have to respect the office he is in.

    The job description for a soldier is not to decide on his own whether a President is fit to obey or not. His duty is to obey if the law given is lawful. Period.

    As a US citizen and obvious patriot of this country and the principles it was founded upon, Sgt Cook has every right to refute the legitimacy of this administration.

    To the chagrin of Nancy Pelosi and the democratic majority, the Constitution is still the supreme law of the land. And as such, it specifically outlines the criteria for hopeful candidates to run for any elected office, including president. If Obama fails to present his birth certificate, he forfeits his title. Period. It is not a question of CITIZENSHIP. The problem is he was NOT BORN IN THE US which means he does not measure up to Constitutional standards. Look it up.

    As for McCain, he was born on a MILITARY base on US territory. Which, if you would check the Constitution, is perfectly acceptable.

    Another question for those of you who read and commented on this: how many of you have served in the armed forces? And why should this soldier have to serve under a man who at every opportunity scoffs the very nation he represents? Barack Obama has served no time in the armed forces, barely any time in political office, and to think he supports this war is laughable. He would rather grovel at the feet of the Taliban than fight the dangers of the radical Islamic oppression they embody. Why fight for that? A soldier fights for his COUNTRY not its LEADER.

    So, my question is: Why aren’t more soldiers doing this?

    This soldier is not only defying orders of Commander in Chief, but also the many Officers in his chain of command that have given him orders.

    Soldiers can’t pick and choose which orders they will obey. Does not work like that.

    He is the President of the United States/Commander in Chief.

    Get over it!

    Elections have consequences.

    MxcCain was not born in this country either. Republicans do not have a case here. So even if Obama is not President, by their logic, the election should have gone to some third party candidate.

    The problem is that it is not up to the soldiers to decide for themselves on their own which President is legimate and which is not. There is a legal process for that. Disobedience to orders is violation of one of the sacred oaths the soldier gives. Under our Constitution, Obama is our President until the legal process decides otherwise. If he is proven to be not born here, then impeachment or whatever is dued. But that is not for our soldier to decide.

    Do you want to turn it around? Liberals for eight years act like crybabies saying that Bush stole the election (never mind he wanted the whole state of Florida recounted if there is a recount, while Gore only wanted only counties that sided with Gore to be recounted, so if anybody is trying to steal the election, it would be Gore and the Democrats). By your logic, a soldier, who is liberal and felt Bush was not legitimate President, would be right to say he does not have to obey President Bush. Would you agree to that?

    Conservatives who support this soldier are just as bad as liberals who try to undermine Bush for eight years by saying he is not legimitate President.

    Look, I am both fiscal AND moral conservative. And I think if Obama keeps up his policies the way he have, he will make Bush look like Lincoln, Washington, and JFK.

    So I hold no love lost for Obama. But we still have to respect the office. Getting behind a behaviour that is unprofessional and unbecoming of a soldier is not a way to do it. Obama as long as he is President is owed obedience by those He is commander in chief over, as long as the order is not asking a soldier to commit atrocities condemned by us and worldwide.

    Obama and his supporters have the high moral ground on this issue.

    Put down the crack pipe. It is clouding your judgment. The Constitution says no such thing. Hawaii, as far as I know, became a state on August 21, in 1959. Barack Obama appears to have been born in 1961. He has produced his birth certificate as been verified by multiple agencies including the Associated Press. The state of Hawaii has even put out a press release stating that the birth certificate was authentic.

    I guess the reason why more soldiers are doing this kind of stupid act is because it’s stupid.

    You are correct. The meaning of “natural born citizen” has not be defined by the Supreme Court. It can mean almost anything.
